Hundreds of foreign portfolio investors and some private equity funds still face the risk of being taxed in India for indirect transfer of shares of Indian companies because the leeway announced in the budget is available to only certain categories of investors, tax experts said.

A member of the government’s financial system inquiry, Kevin Davis, warns a tax structure used to attract investors across property, infrastructure and government privatisations is rife and should be banned given Australia is almost alone in providing such generous tax advantages to foreign investors.

“If your turnover in 2015-16 was Rs 50 crore then you will be subject to 25 per cent tax. We will come out with clarification on (applicability of the tax benefit to) new companies,” Chandra said.

The Centre clarified that foreign portfolio investors (FPIs) would not have to pay tax in India for assets sold overseas even if the underlying value is derived from Indian assets, providing a breather to such entities.
